El concepto autónomo de “detención” en el Derecho penal de la UE. De la orden de detención europea a la necesidad de una apreciación sistémica del concepto

Resumen

“Detención” es un concepto crucial en el marco de cooperación judicial de la UE. A falta de una definición normativa común, el Tribunal de Justicia de la UE interpretó la “detención” como un concepto autónomo del Derecho de la UE en el asunto JZ. Este artículo pretende ilustrar el razonamiento del Tribunal en el asunto JZ y las implicaciones sistémicas de esa noción autónoma en el marco de la cooperación judicial. En este sentido, se selecciona la Decisión marco sobre la Orden europea de vigilancia como estudio de caso, demostrando cómo la noción tal y como se enmarca en JZ puede no ajustarse a todos los instrumentos de cooperación judicial. Estas consideraciones se integran finalmente en el debate sobre el establecimiento de normas comunes de la UE en materia de detención.
