Abstract

This paper defines the concept of illegal State aid based on what is established in article 107 of the TFEU, its modalities and its causes. This will serve to determine in which cases the recovery duty imposed by the European Union is activated in the event of illegal aid and the mechanisms available to Spanish law to comply with said duty
