Pre-trial detention and European Arrest Warrant

This paper analyses the impact that the fact that a person is in prison in Spain may have on the effective surrender of a person sought by virtue of a European Arrest Warrant, explaining what can be deduced from the Framework Decision regulating the European Arrest Warrant and from Spanish legislation, constituted by Law 23/2014, of 20 November, on the mutual recognition of judicial decisions in the European Union.
