Cooperation and Verification Mechanism for Romania and Bulgaria. An assessment of its impact on the Rule of Law

The recent completion of the Cooperation and Verification Mechanism (CVM) in September 2023 opens up the possibility to assess what effects it has had on improving the Rule of Law in Romania and Bulgaria. This mechanism is classified as conditionality due to its binding nature for the imposition of sanctions by the Commission in case of non-compliance with the reforms agreed in the Act of Accession to alleviate the so-called systemic deficiencies in the rule of law before their accession. The objective of this article is to analyze the usefulness of the conditionality processes to which the Member States are subjected and to measure the scope of the CVM as part of these post-accession processes.
