PRODUCTION AND PRESERVATION ORDERS FOR ELECTRONIC EVIDENCE IN CRIMINAL PROCEEDINGS

The aim of this paper is to analyze the Proposal for a Regulation of the European Parliament and of the Council on European Evidence Warrants for the purpose of criminal prosecution. It will cover the period from the first text presented by the Commission on 14 April 2018 to the final compromise text of the beginning of this year, with a special focus on the effectiveness of this new procedural instrument. Likewise, we will make a critical assessment of the possible improvements and shortcomings with respect to the procedural guarantees and fundamental rights of those under investigation, which the Proposal presents.
