The principle of non bis in idem, defined as the right not to be tried or convicted twice for the same offence or the same facts, has been enshrined as a fundamental principle in the European Union's legal system through international instruments such as Article 50 CFREU, Article 54 of the CISA and Article 4 of Protocol No. 7 ECHR. Due to its importance in ensuring the free movement of persons, this paper aims to explain how this principle has evolved in the European Union, both in the legislative and jurisprudential spheres, as part of the Schengen Area.
