The Amnesty of Organic Law 1/2024: application and questioning in light of European Union Law

Organic Law 1/2024, through the amnesty, requires Courts to extinguish criminal liability for certain criminal acts (categorized as embezzlement or terrorism, for example). In application of said Organic Law, some Spanish Courts have granted amnesty for this type of crimes; Others have filed requests for a preliminary ruling due to doubts about the compatibility of European Union law with the aforementioned amnesty. The article includes an analysis of said judicial resolutions issued since the entry into force of the aforementioned Organic Law until mid-September 2024.
