This article focuses on the analysis of the need for judicial authorisation in of assignment measures applicable to cross-border investigations provided in Articles 31 and 32 of Regulation (EU) 2017/1939 establishing enhanced cooperation for the establishment of the European Public Prosecutor's Office, in the light of the interpretation made by the European body itself and the Court of Luxembourg. It ends with a critical commentary on the position adopted by the European Court and the practical and legislative consequences that this may have at national and European level.
