Abstract

this paper analyses the right to dual criminal defence in the field of Extradition law, with special attention to the European Union law, based on the leading case in this matter in which the authors intervened as lawyers defending the Extradition request made by the United Kingdom in the post Brexit era. The authors argue an interpretation of the right to dual representation that respects the essential content of the right to effective legal assistance and avoids the formalistic conception imposed by the Plenary of the Criminal Chamber of the National High Court in its final decision of the case which motivated this paper and that can be summarized as follows: the duty of the authorities of the executing State is satisfied and exhausted with the transfer of information to the requested person of his right to appoint a lawyer in the issuing State.
