Mutual recognition under scrutiny: case C-158-21 Puig Gordi and others and its impact on the future of judicial cooperation in criminal matters in the EU

The aim of this paper is to analyse the request for a preliminary ruling requested by the examining magistrate in the Procés case in March 2021 following the Belgian decision to refuse the surrender of Lluís Puig. After providing a briefing on the background, each of the questions submitted to the Court of Luxembourg will be analysed individually, assessing their relevance and feasibility from the point of view of EU law. It concludes with a reflection on the European significance that the answer to these questions may have in a context of crisis of the principle of mutual recognition
